Frequently Asked Questions

Everything you need to know about challenging unfair private parking charges in the UK.

Do I legally have to pay a private parking ticket in the UK?

No โ€” not necessarily. Tickets issued on private land are civil Parking Charge Notices (PCNs). They are invoices alleging a breach of contract, not criminal fines.

Before paying, you should always check whether the operator followed strict legal procedures under the Protection of Freedoms Act (PoFA) 2012. If they failed to comply with the statutory requirements, the charge may be legally unenforceable against you as the registered keeper.

What is a Geospatial Shield? NinjaPCN

A Geospatial Shield is what NinjaPCN identifies when your PCN postcode falls within a legally protected area โ€” land where private parking operators have no lawful authority to enforce charges under PoFA 2012.

Certain areas across England and Wales carry legal protections that place them entirely outside the reach of private parking enforcement. Most drivers โ€” and many parking companies โ€” are completely unaware these protections exist.

NinjaPCN cross-references your exact location against 14 official UK legislative datasets covering over 140,000 mapped sites. If your postcode falls within one, a shield is triggered and a custom appeal letter citing the exact statutory instrument is generated for you.

What is the "14-day rule" under PoFA 2012?

Under Schedule 4 of the Protection of Freedoms Act 2012, if a private operator uses ANPR cameras (and did not physically attach a ticket to your windscreen), they must deliver the Notice to Keeper (NTK) to your registered address within 14 days of the alleged incident.

If the notice arrives on day 15 or later, they lose the statutory right to claim Keeper Liability. Without identifying the driver, they cannot legally enforce the charge against the registered keeper of the vehicle.

Does NinjaPCN work against ParkingEye, Euro Car Parks, and APCOA?

Major operators including ParkingEye, Euro Car Parks, Horizon Parking, Smart Parking, APCOA Parking (e.g. APCOA Parking at Manchester Airport), Civil Enforcement (e.g. Civil Enforcement at London Heathrow Airport), Initial Parking (e.g. Initial Parking at White Moss), and GroupNexus (e.g. GroupNexus at Cardinham Woods) are bound by the Protection of Freedoms Act. You can also view some of the popular locations on our popular sites page.

If a Geospatial Shield is found for your location, these operators have no legal basis to pursue the charge regardless of their signage or ANPR evidence โ€” the land itself falls outside the scope of PoFA.

What is the difference between a Council parking ticket and a private PCN?

A council ticket is a Penalty Charge Notice โ€” a statutory fine issued under public law by a local authority or police. NinjaPCN cannot help with these.

A private ticket is a Parking Charge Notice โ€” a civil invoice issued by a private company under contract law. These are what NinjaPCN is designed for. Private operators must use independent arbitration bodies like POPLA or the IAS, where technical and geospatial defences are highly effective.

What am I buying?

A custom-generated appeal letter built specifically for your location. Unlike generic templates, NinjaPCN identifies the exact legal reason your charge may be unenforceable โ€” and cites the specific statute that applies to your exact parking spot.

The letter is ready to submit immediately. No legal knowledge required.

Why does NinjaPCN need zero personal information?

Private parking companies use personal data to intimidate motorists into paying quickly. Many appeal services harvest your name, email, and registration details.

NinjaPCN operates on a strict zero personal data policy. We never store your name, email, phone number, or vehicle registration mark. The only data we use is the postcode of the alleged incident โ€” and even that is only stored in our anonymised audit log, never linked to an individual.

Does NinjaPCN work in Scotland?

Partially. The Protection of Freedoms Act 2012 (PoFA) extends to England and Wales only. Scotland operates under different legislation, so the PoFA Keeper Liability defence does not apply north of the border.

However, some of our geospatial layers are specific to England. Other layers may have some Scottish coverage. We recommend checking your postcode โ€” if a shield is found, the appeal letter will cite the applicable statutory instrument for that specific location.

What do I do after downloading my appeal letter?

Once downloaded, open the PDF and insert your specific details into any bracketed fields (such as your PCN reference number if you did not enter it during the check).

Step 1 โ€” Appeal to the operator directly. Submit the letter through the appeals portal on the back of your parking ticket โ€” usually the operator's own website or via email. Keep a copy for your records. This step alone is often enough and the charge is cancelled.

Step 2 โ€” If rejected, appeal to an independent adjudicator. The operator must issue you a verification code or appeal reference number with their rejection. Use this to escalate your appeal to POPLA (if the operator is BPA-accredited) or the IAS (if IPC-accredited). Submit the same letter with any additional correspondence.

The adjudicator's decision is legally binding on the parking operator, so they MUST cancel the fine. If your appeal is successful, the parking charge is cancelled and the operator cannot pursue it further through any debt recovery or court action.

Important: most operators require your initial appeal within 28 days of the notice date. Don't delay.

Is NinjaPCN legal advice?

No. NinjaPCN is a geospatial data tool, not a law firm. We identify factual information about the legal status of land and generate appeal letters based on that data. This is not legal advice and should not be treated as such.

The appeal letters cite verifiable public legislation and official datasets. The outcome of any appeal depends on the specific facts of your case, the operator's response, and the adjudicator's decision. NinjaPCN accepts no liability for the outcome of any appeal.
